Do you need some extra cash? 

 

I was talking to my friend Josh tonight (yes, the same Josh who many of you met in Vegas – he was the one doing the video shoot for the Rock Stars and the Video Bible Project).  He is a serial entrepreneur like many of us…and not only does he have a thriving international video production company but he just started a new venture with the gold business and can’t keep up with the demand.  He was asking me if he should put ads on Craigslist to hire all the people he needs.  I made him promise to not do that until I could get the information out to all of you first.  I figured extra money is always good and you would be working around gold/silver, coins, estates and collectibles – a world that many of you are already very familiar with!  It’s a great opportunity, part or full-time, positions in management if you would like AND I happen to know that some of the staff travels with him too (ALL expenses paid – egads!)  The shows sound like SO much fun – in fact I’ll be heading up to Michigan to work with Josh on some of this.  If you are interested, email him (josh@thespenceragency.com) ASAP as I know he is hiring quickly for these newly opened positions.  Here is the ad he sent me:

 

If you’re looking for a full time/part-time job, OR just some extra spending money, I may have the perfect opportunity for you.  We have openings for a number of different job positions with pay ranging from fifteen to twenty-five dollars per hour.  A typical day at work would be Thursday through Sunday from ten am to five pm with some openings in the evenings through out the week.  As a member of our team, you would greet the customer as they arrive at events to sell their gold and silver, and walk them through a process that we would fully train you on.  During your time with each customer, you would determine the karat, weight and value of their gold and silver.  If they decide to sell, you would write up the order on the company invoice and send the customer to the cashier to check out.  Some of our team has an opportunity to travel with all expenses paid! 

Most of the testing positions are available paying $15 an hour.  Local management positions are available at a greater pay up to $25 per hour.  Managers would obtain extensive training to learn the process of testing precious metals, and would hold a management role over a team of testers at one of the Gold and silver buy back events.  I have started to interview applicants and collect resumes and plan to fill all positions in July.  If you live near any of the cities listed below and would be interested in applying. eBay’s giving $$$ away at the party – we have the details

 

HOT NEWS FROM EBAY!!!

eBay will be filming at the eBay Radio Party, both party events and individual eBayers. Here’s the 411, in their own words: “The goal is to capture seller and uniquely eBay stories on camera.  There will be a question set we’ll ask participants to answer in their own, unique way.” This is a contest, with the top 5 videos to be put on a web site and judged after the event. The grand prize winner will receive $1,000 with the four runners-up each receiving $250. I’ve heard the working theme is “I am eBay”, so be ready to tell the cameras why YOU are eBay!

(LOL..I am laying odds on the Rock Stars winning a few of these! They are fabulous eBayers.)

 

 

Tips on getting the most out of this conference, oops, I mean party

Yes, we are going to have blast hanging out with friends – new ones and ones we haven’t seen in a while.  But keep in mind that you are also there for your business.  The Rock Stars already went through this training last year, but here are some ideas that should help prep you to get the most out of this upcoming event:

1.  Make a goal sheet – I do this for every event I am going to whether it is 2 hours long or a huge conference.  With this goal sheet I remain focused on what I came there for and not get sidetracked with other sparkly things (which will be SO easy to do in Vegas).

2.  Networking – since some top players will be there both from eBay itself and the eBay world, who do you want to make a connection to?  Now I’m not talking about the ‘OMG, I can’t believe I just shook so and so’s hand!  Eeks!’ type of connection.  But who at this event can take your business to the next level. (and don’t just put everyone on your goal sheet – be specific and focused).

Auctiva, Moneybookers, ShipRush and Vendio are definitely going to be there.  They will be easy to track down since they are sponsors of the event.  What questions do you have for them?  Are you prepared to tell them the processes in your business and ask how they can help you?  Are you currently using their products, but want to know how to use it more efficiently.  Put all that down on your goal sheet.

Now, I also happen to know that a few other companies are heading to the party too.  Big hint…follow us on Twitter hashtag #ebay09 to get the latest updates on the whos who that are hitting the events.

3.  Marketing – On my goal sheet is always a section for marketing.  Choose one focus (to get people to sign up for your newsletter or go to your eBay Store or follow you on Twitter) and make sure your marketing materials generate the results you are wanting.  The reason for the one focus is so you don’t dilute or confuse the readers with your messages.  This one is HUGE people.  You are going to an event that potentially has 200 people who could either be buyers or some of your best ‘talkers’ about your products (not to mention ALL the people .  What a great opportunity.  Make sure you are prepared.

4.  HAVE FUN!  Most important of all tips.

 

 

Getting around Vegas – these are my top tips for Vegas (and we have some great tips from local Jason too!)

What to Bring to eBay Live
Here are some of my ideas on what to bring to the conference.

• backpack/wheeled one
• very comfortable shoes
• tad nicer outfit for the evening
• clothes with your name ALL over them for marketing purposes
• calendar of events
• camera
• sunscreen - it will be around 100 degrees
• bottled water (you can buy when you get to Las Vegas, but they are a bit expensive)
• business cards & other marketing items
• empty suitcase
• laptop - but leave in room

Networking is a critical component of every trade show - get out there and talk to people!

 

Here are ideas on how to market your eBay business while you are there.

• Business cards
• apparel
• postcards
• your product
• presentation folders
• pins

 

Getting Around Las Vegas
When you get to baggage claim at the airport, look up for the signs directing you to various doorways. Through these doorways you will be able to take a shuttle, a taxi, and even a limo to your hotel for eBay Live.

Note: If you are staying at Ballys, Flamingo, the Hilton, Caesars Palace, New York NY, Paris, Rio or MGM Grand, you can check into your hotel in the baggage claim area. These hotel check-in locations are located around the perimeter of the baggage area.

Airport Shuttles:
There are approximately six shuttle companies that can get you from the airport to your hotel. They average between $5-7 per person depending upon how far you are going (or $8-10 for a round trip ticket). My recommendation…here is one place you should splurge. The shuttles wait until they are mostly full before they leave, and then they have various stops along the way. This can mean waiting up to an hour before you get to your hotel. No matter where you are going, it always seems like your stop is last.

Taxi
Instead, head to the taxi line, which will look long, but it moves quick. (Tip: there is a smoking line and a non-smoking line, pick appropriately.) A taxi cab ride will run you around $15 to $20. This does not include a tip. Since they handle all 6 of my bags (hey, I am a girl) and give me hot tips on the best places to eat, I usually tip 15-20 percent.

Limo
My favorite trick in Vegas is to arrive at my hotel in a limo. The limo is $38 before tip (cash only, they do not take credit cards any longer). However, there is never a line to get a limo, the drivers are wealth of knowledge about what do (& not to do) in Vegas, they usually have cold water waiting inside, and (here is the best part), it is not $38 per person. Round up a couple of your new eBay Live friends you met on the plane, or while waiting for your luggage and share a limo. With six of you, that is only $9 per person with tip!! Make sure you get their business card for one of your nights out on the town.

Tram:
There are 3 trams on the Vegas strip. The tram at the end of the strip where eBay Live is being held is called the Mandalay Bay - Excalibur Tram. Heading south-bound, it starts at Excalibur and doesn’t stop until Mandalay Bay. However, heading northbound, it includes a middle stop for the Luxor. The tram operates 24 hours a day and leaves the station every 3-7 minutes.

Everything You’ve Wanted to Know about Tipping in Las Vegas
Pretty much, if someone does anything for you in Vegas, they are expecting a tip…this is how they make their living. Your level of service throughout your trip will depend upon your tipping abilities. Here are some tips (no pun intended) to make your trip a smooth one.

• Cocktail Waitresses: Drinks are free while you’re gambling - even in the penny slot area. I usually give the cocktail waitress a $1 each time she brings me a drink. If you want her to come around more often, tip bigger. Tip: You don’t have to order a cocktail from them…they will bring you almost anything; bottled water, ice tea, lemonade, etc.
• Shuttle bus drivers: If you are taking the shuttle from the airport, typically you would tip $1-2 per bag. If you are just taking a shuttle between hotels, then I would recommend handing $1-2. to the driver.
• Bellman: $1 to $2 a bag is the norm. However, I usually also make sure I ask them all the questions I can think of…where’s the thermostat, can you get me a bucket of ice, where is the room service menu (is it any good?), who should I ask for to get the best seats for the show…because they know! If you capitalize on your bellman’s vast knowledge of all things Vegas, then give them a few bucks extra.
• Hotel maid: I leave a daily tip, usually $5 or so. (perhaps a bit more if you hosted an eBay party the night before in your room!) Since you will have many different people cleaning your room, don’t leave one big tip at the end.
• Room Service: This is a tricky one. Some hotels include gratuity into your bill already, but still have a line for an additional tip. Make sure you aren’t double tipping. I commonly tip around 15-20% for room service - just as I would in a restaurant. You can either add this onto your room charges or give them cash or chips directly.
• Buffet waiters/waitresses: Although the buffets do not have typical waiter and waitresses like the restaurants, I still tip them. Their job is to refill your drinks and remove dirty plates. Commonly $2-3 per person at the table is good.
• Cab Drivers: The traditional 15% will work for a cab ride, but many of these drivers are a wealth of knowledge. They know what is going on in Vegas, best places to shop, the restaurants the locals eat at, and even how to get tickets to a sold-out show. Tip them a few dollars more for the additional 411. If you are using a cab to get from one location to another in Vegas, use the taxi lines in front of the casino/hotel. They move pretty quickly. Don’t forget to tip your doorman a couple of dollars for working hard on keeping that continuous line of taxi’s coming.

Big Facebook News

Holy Cow – Friday on Facebook was insane.  I am glad so many of you were able to grab your personalized URL’s on Facebook, unfortunately many weren’t (or still haven’t heard about it yet – eeks!)  I am sure someone will grab www.FacebookURLsForSale.com and make a great business out of reselling accounts, albeit illegally. 

OSI Rock Star Bryan of Flightline Fabrications fame and his family were up in Seattle – always fabulous to see them.  We should have got video of Bryan and I ignoring everyone else at the table during dinner, laptop with the wireless card set up right at 8:55pm, and some intense URL grabbing for our multiple Facebook accounts – such humorous entrepreneurial behavior to the rest of the world.  His delightfully charming Uncle Ross was asking me what a ‘Facebook’ is and telling me that a ‘laptop’ is a napkin – had me in tears laughing so hard.

Update on eBay Announcements

HUGE thanks to OSI Rock Star Marlene for catching an update I missed (I was so excited about the Facebook URL event, I completely forgot).  eBay has relented and Picture Manager will be good to go until January 2010 – WooHoo.  Gives us a bit more breathing room to maneuver through the other changes.  There is a great thread started on OSI Rock Stars by Kelli of Dream Adventures about where else people are going to be hosting their pictures.

I can’t believe we leave in almost a week for eBay ‘live’!  Yes, I know it’s not really eBay Live…but a girl can dream.

What to Bring to eBay Live
Here are some of Janelle’s ideas on what to bring to the conference.

• backpack/wheeled one


• very comfortable shoes


• tad nicer outfit for the gala


• clothes with your name ALL over them for marketing purposes


• calendar of events


• camera


• sunscreen - it will be around 100 degrees


• bottled water (you can buy when you get to Las Vegas, but they are a bit expensive)


• business cards & other marketing items


• empty suitcase


• laptop - but leave in room

Networking is a critical component of every trade show - get out there and talk to people!

 

Here are ideas on how to market your eBay business while you are there.

• Business cards

Getting Around Las Vegas
When you get to baggage claim at the airport, look up for the signs directing you to various doorways. Through these doorways you will be able to take a shuttle, a taxi, and even a limo to your hotel for eBay Live.

Note: If you are staying at Ballys, Flamingo, the Hilton, Caesars Palace, New York NY, Paris or MGM Grand, you can check into your hotel in the baggage claim area. These hotel check-in locations are located around the perimeter of the baggage area.

Airport Shuttles:
There are approximately six shuttle companies that can get you from the airport to your hotel. They average between $5-7 per person depending upon how far you are going (or $8-10 for a round trip ticket). My recommendation…here is one place you should splurge. The shuttles wait until they are mostly full before they leave, and then they have various stops along the way. This can mean waiting up to an hour before you get to your hotel. No matter where you are going, it always seems like your stop is last.

Taxi
Instead, head to the taxi line, which will look long, but it moves quick. (Tip: there is a smoking line and a non-smoking line, pick appropriately.) A taxi cab ride will run you around $15 to $20. This does not include a tip. Since they handle all 6 of my bags (hey, I am a girl) and give me hot tips on the best places to eat, I usually tip 15-20 percent.

Limo
My favorite trick in Vegas is to arrive at my hotel in a limo. The limo is $38 before tip (cash only, they do not take credit cards any longer). However, there is never a line to get a limo, the drivers are wealth of knowledge about what do (& not to do) in Vegas, they usually have cold water waiting inside, and (here is the best part), it is not $38 per person. Round up a couple of your new eBay Live friends you met on the plane, or while waiting for your luggage and share a limo. With six of you, that is only $9 per person with tip!! Make sure you get their business card for one of your nights out on the town.

Tram:
There are 3 trams on the Vegas strip. The tram at the end of the strip where eBay Live is being held is called the Mandalay Bay - Excalibur Tram. Heading south-bound, it starts at Excalibur and doesn’t stop until Mandalay Bay. However, heading northbound, it includes a middle stop for the Luxor. The tram operates 24 hours a day and leaves the station every 3-7 minutes.

Everything You’ve Wanted to Know about Tipping in Las Vegas
Pretty much, if someone does anything for you in Vegas, they are expecting a tip…this is how they make their living. Your level of service throughout your trip will depend upon your tipping abilities. Here are some tips (no pun intended) to make your trip a smooth one.

• Cocktail Waitresses: Drinks are free while you’re gambling - even in the penny slot area. I usually give the cocktail waitress a $1 each time she brings me a drink. If you want her to come around more often, tip bigger. Tip: You don’t have to order a cocktail from them…they will bring you almost anything; bottled water, ice tea, lemonade, etc.


• Shuttle bus drivers: If you are taking the shuttle from the airport, typically you would tip $1-2 per bag. If you are just taking a shuttle between hotels, then I would recommend handing $1-2. to the driver.


• Bellman: $1 to $2 a bag is the norm. However, I usually also make sure I ask them all the questions I can think of…where’s the thermostat, can you get me a bucket of ice, where is the room service menu (is it any good?), who should I ask for to get the best seats for the show…because they know! If you capitalize on your bellman’s vast knowledge of all things Vegas, then give them a few bucks extra.


• Hotel maid: I leave a daily tip, usually $5 or so. (perhaps a bit more if you hosted an eBay party the night before in your room!) Since you will have many different people cleaning your room, don’t leave one big tip at the end.


• Room Service: This is a tricky one. Some hotels include gratuity into your bill already, but still have a line for an additional tip. Make sure you aren’t double tipping. I commonly tip around 15-20% for room service - just as I would in a restaurant. You can either add this onto your room charges or give them cash or chips directly.


• Buffet waiters/waitresses: Although the buffets do not have typical waiter and waitresses like the restaurants, I still tip them. Their job is to refill your drinks and remove dirty plates. Commonly $2-3 per person at the table is good.


• Cab Drivers: The traditional 15% will work for a cab ride, but many of these drivers are a wealth of knowledge. They know what is going on in Vegas, best places to shop, the restaurants the locals eat at, and even how to get tickets to a sold-out show. Tip them a few dollars more for the additional 411. If you are using a cab to get from one location to another in Vegas, use the taxi lines in front of the casino/hotel. They move pretty quickly. Don’t forget to tip your doorman a couple of dollars for working hard on keeping that continuous line of taxi’s coming.

eBay BIG announcements – a complete run-down of all of the updates, changes and important info that eBay has released

Are you guys on top of ALL the new changes that were just announced at eBay?  Some pretty important ones with specific dates that we need things done (or our pictures and listings go bye-bye – eeks!)  Well, good news is that there were no fee changes!!  WooHoo.  I have created a special gift for you (took me two days to finish it!)…a special guide to ALL of the changes & updates that eBay is making.  You can find the link to get yours below.  Being on top of these changes will only make you more successful – and your Success is very important to me.

 

Now, I hope I don’t have to remind anyone about getting caught up in the details of what eBay is doing and flip flopping their business because of these or any other announcements.  You are all professional business owners who dictate how their business is going to run.  For instance, no one should have any major issues with the new ‘dispute policy’ since your own customer service/return policies should be exemplary in making your customers delighted.  Sellers who are going to take issue with this new policy are the ones who allow eBay to dictate the minimum level of customer service that their business should have to stay afloat.  I want you to take a look at the new updates and see how they apply to your own individual business.  For the Rock Stars, this will include checking your RoadMap to Success and seeing if it needs to be updated at this point.

 

So the announcements were about 3 main areas on eBay:

1. Easier, more visual shopping and buyer incentives to drive more sales


2. Key information to set buyer expectations and reduce your costs


3. More updates to make selling on eBay more efficient

These 3 areas and their specifics will make a lot more sense once you take a look at the special guide we created for you.  There are however, some points that came up in the Town Hall that I would like to mention:

 

• eBay acknowledged that they have not done the best job in the past with getting information out to the sellers in a timely fashion.  Starting with this announcement, all sellers will be given at least 60 days to make any changes to their business before eBay takes action.


• Multiple Item Listings – more categories are coming later this year


• Picture Manager will be phasing out after August


• eBay is merging the About Me page with the My World page


• If you are a Basic eBay Store owner, you will be given the opportunity to upgrade to Selling Manager Pro at a discount in June.


• Also, on your new preview pages there is a link that says ‘Send us your comments’ – feel free to let eBay know what you like and don’t like.


• Some of the bigger changes are happening to the jewelry/watch sellers on eBay


• Keep in mind, many of these decisions are done to make customers HAPPY.  Happy customers=more sales=more profits for you!

Here is the article about the study that comScore recently did:

A surge in the annual growth of local search far outpaced growth of overall Web search, according to a study from the Yellow Pages Association (YPA), conducted by comScore, Inc.

The study found that local search - the practice of using online search tools to find local businesses, products, or services - grew 58% in 2008, reaching an annual total of 15.7 billion searches. By comparison, overall core US web searches grew at a much smaller rate of 21% year-over-year, nearing 137 billion searches by the end of 2008.

Local searches now stand at 12% of core searches on the top 5 portals, according to the YPA.

Buoyed by the growth in local search, the YPA said that Internet Yellow Pages (IYP) and other locally focused online business directories also saw double-digit growth of 23% in the same period, totaling 4.6 billion searches in 2008.

As more users conduct local searches, exposure to sponsored links for Yellow Pages data is increasing as well, YPA reported. Year-over-year, IYP sites have seen their exposure to sponsored links increase 50% to reach 353 million in December 2008 alone, demonstrating the increasing need for local business information.

“As local search grows, our data becomes more valuable,” said Neg Norton,YPA president. “Even if the searcher doesn’t know the company or brand they will ultimately give their business to, the decision to actually make a purchase has often already been made. That is a strong argument for local merchants to develop and maintain an online profile, if they haven’t already done so.”

Additional study findings:

·         75% of the top 100 keywords searched on Internet Yellow Pages sites were non-branded, indicating that a majority of consumers have not decided on a specific company or product brand when they begin their search.

·         Nearly half (45%) of Internet Yellow Pages and local online directory searchers made an online purchase in the fourth quarter of 2008.

A recent report from Borrell Associates noted that small and medium-sized businesses are increasing their investment in local, interactive advertising and are now investing 11% of their advertising dollars online, up from less than 4% three years ago.

“I am a Web designer who helps companies – mostly small businesses – build their websites and create an e-commerce presence on the Internet.  I ask my clients for an upfront deposit with the balance due upon completion of the project they’ve asked me to do.  I’ve had a couple of situations recently where a client has retained me to build a website, paid the upfront deposit, and then disappeared off the face of the Earth.  They don’t respond to my requests for information, and when I send them proofs to review, they take forever to get back to me.  I want to take on other clients, but I’m afraid these ‘now you see them, now you don’t’ clients will come out of the woodwork and demand that I finish their projects on a ‘rush’ basis at the worst possible time for me.  I can manage my own time extremely well, but how can I better manage my clients’ time so that we both can get the results we want out of this relationship?”

We all like to think we are our clients’ top priority in life, but of course, that’s seldom true.  Especially in the current economy, a lot of clients are so busy “putting out fires” that they put our projects on a “back burner,” or ignore them altogether for a while.  Sadly, this is especially true of Website and other marketing-related projects that are not deadline sensitive.

Whenever you price your services on a “project” basis, you take on several risks:  that the project will take longer than expected, that the client won’t respond to requests for information in a timely fashion, that you and the client will disagree over when the project is “completed” (when is a Website ever “completed”?), and so forth.

The obvious solution is to charge a straight hourly rate on all projects, but that isn’t always practical.  Here are five clauses that should be in your service contract whenever you quote a fee for a particular “project”.

A “Nonrefundable Deposit” Clause.  You are absolutely right to insist on an upfront “advance” for your work.  Now, all you need to do is add one little word to your contract:  “nonrefundable”.  Make it clear that if the client is unresponsive, he will forfeit his deposit.  Also, make sure the deposit amount is large enough that your client will take the threat of forfeiture seriously.

A “Changes to Scope of Work” Clause.  Your contract should state that the fees quoted are only “estimates” based on your assessment of the amount of time the project will take, and hold the client accountable for any additional work they may (and usually will) request.  Here’s a sample:  “Client shall be responsible for making additional payments for changes necessitated by Client revisions and/or additions following Client’s approval (other than for Consultant’s error) and will be billed additionally at the rate of $___.00/hour.”

An “Overtime” Clause.  Make it clear that you are not going to work 24/7 without being paid for it.  Here’s a sample:  “Fees quoted are based on work performed during the course of regular working hours. Rush, holiday, and weekend work necessitated by Client’s directive is billed in addition to the fees quoted, at an hourly rate of $___.00.”

A “Kill Fee” Clause.  If the client is really unresponsive, you should have the right to cancel the contract and keep the client’s deposit.  Here’s a sample:  “In the event of your cancellation of this project, or any delay of more than one month  in responding to Consultant’s request for information or review/approval of proofs, Consultant will have the option of terminating this agreement, and invoicing you for the greater of: (1) all work completed up to the date of written notification, including expenses, at the rate of $__.00 per hour or such other rate as shall be specified in this agreement; or (2) the amount of any advance deposit made for this project.  Any renewal of this project after termination will require a new agreement, fee schedule and upfront deposit.” 

An “Ownership of Rights” Clause.  While the client should always retain their ownership of any materials they submit to you for use in the project, you should hold off giving your client rights to any work product you develop for them until such time as all fees have been paid in full.  Here’s a sample:  “You will retain all intellectual property rights of source material (e.g. copy, photography) provided to Consultant for use in connection with this project; however, Web content, design, and other work product created by Consultant and similar products and materials will remain the property and copyright of Consultant until all fees under this agreement have been paid in full.”

One more thing:  try to avoid “payment upon completion” language wherever possible.  A better approach is to bill your clients by the hour, with an “incentive” payment (10% to 20% over your estimate) if you finish the project to your client’s satisfaction by a specified date.

“We started selling on eBay a few months ago.  We’ve had spectacular success with most of our items, but recently have had two listings removed from the site because of alleged trademark violations.  eBay told us that unless the manufacturer contacts eBay to resolve the violation request, we are suspended from selling on the site for one year.  We have attempted to contact the manufacturer to discuss the situation, as in both cases the items we had for sale were 100% genuine, but there has been no response.  Is there any way a seller can get justice in a situation like this?”

Sadly, the answer is “probably not”.

It is illegal to sell counterfeit or “knockoff” merchandise on eBay, or in fact anywhere else.  These products are manufactured in violation of U.S. and international trademark and copyright laws, which are designed to protect the manufacturers of these goods (think Tiffany’s or Louis Vuitton), their brand names and their “brand image” in the marketplace.

Manufacturers have an absolute right to block the sale of counterfeit or unauthorized merchandise on eBay, but they cannot legally prohibit the sale of used or secondhand merchandise if it is in fact genuine.  So the manufacturer of Coach handbags should have no right to object if you’re selling on eBay a genuine vintage Coach handbag you acquired in an estate sale.   Since most eBay sellers are not experts in the merchandise they sell, how can the typical eBay seller know whether the brand name merchandise they’re selling is genuine or not?

To deal with this situation, eBay long ago developed its Verified Rights Ownership (“VeRO”) program (http://pages.ebay.com/help/tp/programs-vero-ov.html).  Here’s how it’s supposed to work:

O         manufacturers of brand name merchandise create an “About Me” page on eBay with information and resources to help eBay sellers determine whether the merchandise they’re selling is genuine or not;

O         if a manufacturer believes a seller is selling counterfeit or “knockoff” merchandise, it notifies eBay, which then shuts down the offending listing and instructs the seller to contact the manufacturer directly to resolve the matter;

O         the seller contacts the manufacturer, and the question of genuineness is resolved one way or the other; and

O         if the manufacturer doesn’t respond to the seller, eBay contacts the manufacturer on the seller’s behalf and “facilitates” the discussion.

That’s all great in principle.  But it doesn’t work in practice.  Manufacturers do not like the idea of even legitimate brand name merchandise being sold on eBay, because it circumvents their other distribution channels and (in their view) cheapens their brand image in the marketplace.  While eBay doesn’t want to frustrate its sellers, it is absolutely petrified of being sued by large manufacturers, and so gives in to most VeRO requests to suspend a seller’s listings (or the seller itself) with hardly any investigation.

Here’s a recommendation for an improved VeRO that may level the playing field between sellers and manufacturers without exposing eBay to unnecessary risk:

(1)       whenever a seller includes a brand name or trademark in a listing title, he or she should be required to fill out a separate box with evidence demonstrating that the item is genuine – this could be a photocopy of the original sales receipt, the story of how the seller acquired the merchandise (what antiques dealers call “provenance”), a certificate of authentication by a recognized independent authority, or a listing of product details that only genuine merchandise would have;

(2)       if a seller completes this “provenance” box, the word “documented” should then automatically appear in the listing title alongside the trademark or brand name (for example, “documented Coach handbag”);

(3)       if a manufacturer complains that a listing offers bogus merchandise for sale, and the listing does not have the word “documented” in the title (i.e. the provenance box wasn’t filled out), eBay can terminate the listing without explanation;

(4)       if a manufacturer complains that a listing offers bogus merchandise for sale, and the listing has the word “documented” in the title, eBay notifies the seller and requires them to contact the manufacturer, via a specific e-mail address, within 24 hours of the notice;

(5)       if the seller fails to contact the manufacturer within 24 hours of eBay’s notice, the listing is automatically terminated;

(6)       if the seller contacts the manufacturer but the manufacturer doesn’t respond to the seller’s inquiry within 24 hours of delivery, then the listing continues and the manufacturer is barred from complaining;

(7)       if the manufacturer responds to the “documented” seller’s inquiry and insists the merchandise isn’t genuine, giving specific reasons why (not just a form response), then eBay suspends the listing (not the seller) and the matter is referred to eBay’s mediation system or SquareTrade for resolution, the same as disputes between a seller and a buyer.

One more thing:  since sales of trademarked merchandise on eBay are occasional or infrequent transactions for most sellers, eBay should never suspend a seller (as opposed to striking individual listings) from the site for VeRO violations absent compelling evidence that the seller is engaged in multiple, repeated sales of blatantly counterfeit merchandise.
